1. Ownership and Declaration of Identity

The brand name “WebFreelancer™”, the domain staging.webfreelancer.in, all associated logos, digital assets, and service frameworks are the exclusive intellectual property of Adnan Buksh, operating as a legally registered Micro-Enterprise under the Government of India.

2. Declaration of “Prior Use” (Section 34, Trade Marks Act, 1999)

In accordance with Section 34 of the Indian Trade Marks Act, 1999, WebFreelancer records its statutory and common law priority.

Established Use: I have consistently used the name “WebFreelancer” in trade and commercial capacity since November 20, 2022.
Superior Rights: Under Indian Law, the rights of a “Prior User” are superior to those of any party who subsequently registers a similar trademark. This notice serves as public, cogent evidence of my first and continuous use of the mark in the software and digital marketing industry (Class 42 & 35).

3. Protection Against “Passing Off”

Any third party using the name “WebFreelancer,” “MrWebFreelancer,” or deceptively similar variations to offer web development or SEO services is guilty of “Passing Off.” I reserve the right to initiate legal proceedings to prevent commercial misrepresentation that causes confusion among my clients and the public.

4. International Intellectual Property Protection

WebFreelancer claims protection under the following international frameworks to safeguard this brand globally:

Berne Convention (1886): Automatic copyright protection for all original content, code, and designs on this website across 180+ member countries.
Paris Convention (Article 6bis): Protection against the use of well-known marks and the right of priority for business identifiers.
WIPO (World Intellectual Property Organization): I monitor global digital registries for unauthorized use of my brand identity.
UDRP & INDRP: I reserve the right to challenge any “Cybersquatting” or bad-faith registration of domains (e.g., .com, .net, .org) that mimic “WebFreelancer” under the Uniform Domain-Name Dispute-Resolution Policy.

5. Unauthorized Use & Cyber Squatting

Any person or entity found doing the following will face immediate legal action:

Registering social media handles or domains using the name WebFreelancer or MrWebFreelancer to benefit from my SEO reputation.
Using my brand name in Meta Tags, Keywords, or Google Ads to divert traffic.
Scraping or replicating my website structure, legal notices, or portfolio.

6. Technical Evidence & Monitoring

I employ advanced digital tracking to protect my brand’s SEO and integrity:

Timestamped Evidence: Every page and update is logged with blockchain-verified timestamps and Google Cache records to prove my date of publication.
IP Logging: All unauthorized attempts to clone this site are recorded via server logs for submission to cyber-crime authorities.
Search Engine Reporting: I actively report brand infringements to Google, Bing, and Meta for immediate de-indexing of infringing parties.

7. Legal Remedies and Penalties

Unauthorized use of this brand identity will result in:

Injunctions: Immediate court orders to stop the use of the name.
